Hammond v Secretary of State for Works and Pension

Please donate a small amount and help contribute towards my legal fees against the injustice caused by the Governments Secretary of State for Work and Pensions. 

The Child Maintenance Service have recently seized £19,269.09 from my bank account just after I sold my home. The CMS claim that the majority of the alleged arrears were from 1999 to 2002. I have substantial evidence which includes three original letters of closure from 2002 and three recently recorded phone conversation with the CSA and CMS who stated that “it is not a genuine debt” and that I don’t owe the money stated. Despite my submitted evidence and help from my solicitor, other departments in the CMS have carried on regardless and taken my money.

I am now 50 years old with my two children aged 29 and 26 years old. In November 2019 the CSA, which were in the process of closing down and deleting all of their records, transferred their old records over to the Child Maintenance Service. I was then sent a letter from the CMS stating that I owed nearly £20,000 from unpaid arrears dating back to 1999. I can’t believe that an organisation can leave a debt for over 20 years and then decide to make a claim when despite several Right of Access Requests, the CMS have supplied no evidence whatsoever.

I initially thought that my case was a one-off error, but sadly not. It would appear that there are literally tens of thousands of similar cases. Shocking statistics from the Consumer Watch Foundation states that 74,700 people have killed themselves since 2003 due to the errors and injustice cause by the Child Maintenance Service.

There is not enough time or space hear to mention the substantial A4 folders of evidence that I have kept. All I can say is that if I cannot win this appeal then I don’t think anybody can. The problem I am having is that I have already spent £10,000 on legal fees in an attempt to claim back £19,000 when I haven’t even been to court yet. Even though I am out of pocket by nearly £30,000, for me this means more than the money but in our judicial system against a biased and corrupt government organisation.

My ideal situation is to first win my appeal and then to make a claim against the Department for Work and Pensions. If this was to happen, I am hoping this would open the floodgates of unjustified claims which I hope would bring about a reform in the failed Child Maintenance Service. Only then will we see a reduction in suicide caused by this heartless and corrupt system.
