Hello my name is Sarah Byrd. I have been fight to get my sin David back from his fathers. He is always withholding my Visitation with my son. And the other day CPS was called out to his house for Child abuse. We have an open cps case against his father and I just filed emergency custody. The court papers said I should seek legal help for this case. I have found someone that can help me I just really need help with the lawyer fees. It’s a hard time with Covid and just having Christmas. I will attach what I Submitted to the courts. so everyone can see what the judge has seen. thank you and God bless and hold your kids tight.
I am David Anderson's, Mother. On December 18, 2020, I was contacted by DCFS ( Department of Child and Family Services) in Elko NV. They contacted me because they have an open case regarding allegations of abuse with regards to Brian Anderson, David's father. The worker informed me that there had been an allegation of abuse. When the worker asked Mr. Anderson for my information, he absolutely refused to give it to them as he did not want me to know about this. I maintain joint legal custody of David, however, Mr. Anderson purposefully denies me my rights as a parent. After a year and a half of forced missed visitations by Mr. Anderson, I was finally allowed to exercise my visitation on December 19th 2020. While traveling to drop David off with me Mr. Anderson was a little late for the drop off. David informed me this was because Mr. Anderson was pulled over for going 94 mph with David in the car. The officer dropped the ticket down to 90 mph. After I spoke with the Social worker, I asked David for his side of the story. He did confirm that his dad has hit, spanked and smack him and his sister, Tori Phillips in the mouth. David also express concern about how much his dad, Mr. Anderson drinks. David reported that his dad has even passed out in the car in the garage directly following a trip to the store with the kids. David was unable to wake his father for several hours. In fact, this happens so regularly that David is often left to take care of himself and his sister while Mr. Anderson is passed out. On one occasion David and Tori were so scared that they couldn't wake Mr. Anderson that Tori called her mom, Robbi Thorn, and left these phone messages. I am extremely concerned for the safety and well being of my son David and his sister. Mr. Andersons behavior is erratic at best. I feel it is in the best interest of David that I receive temporary custody of David until the CPS case is closed and Mr. Anderson obtains an alcohol evaluation, at his own expense and that he follows all of the recommendations of said evaluation .
