Gavin’s Appeal Against Direction to Carry a Whip

Gavin Kelly is a Harness Racing driver who elects not to carry a whip during races. He has raced for almost 2 years without a whip and he has never owned a whip.
Authorities have instructed Gavin that he must carry a whip when driving and have imposed a $1,000 fine for breaching this direction.
There is no rule or policy that mandates drivers must carry a whip, in fact, the rules have been evolving over recent times to restrict whip use.
Gavin has been charged under rule 238. “A person shall not fail to comply with any order, direction or requirement of the Controlling Body or the Stewards relating to harness racing or to the harness racing industry.”
This is a very broad rule that if read literally grants stewards powers to make any direction relating to Harness Racing which beyond reasonableness is absurd.
