Friends of the Canyon is raising money to continue the fight to stop the DIG (Dornin Investment Group) Canyon Residences, a 28-unit apartment building on the bank of Laguna Canyon Creek.

Funds will pay fees for legal counsel (2 actions against the project are in court currently) and for experts to document the danger this enormous building - placed on the eroding bank of an earthen-bottomed Creek - puts neighbors in.

HELP US FIGHT BACK.

Yup, there’s a big hole in the ground – but we’re not done fighting, yet! Ongoing legal cases put the project’s Coastal Development Permit and Conditional Use Permit in doubt.

As residents of Laguna Beach, we expect that our City will protect us during the development process. That has not happened, so we are raising funds to do the job ourselves – protecting neighbors, homes and neighborhoods.

Funds will pay fees for legal counsel (2 actions against the project are in court currently) and for experts to document the danger this enormous building - placed on the eroding bank of an earthen-bottomed Creek - puts neighbors in.

This project violates City code in many ways:

·      The Specific Plan for the area requires that all development be rural and small scale, to protect against greater density than now exists. A 28-unit building in a neighborhood of small homes and businesses does NOT meet that standard.

o   In a court ruling Judge Kim Dunning found that the project was NOT rural, noting it was “…easy to label urban”.

·      The Coastal Development Permit requires accurate information about the location of building relative to the Creek, but Coastal and the City are relying, instead, on surveys from almost 2 decades ago, despite the Creek banks rapidly erosion as evidenced by the City spending $1.5 million on erosion control to protect its own property at the animal shelter only 200 yards downstream.

·      Flood planning for this area requires accurate information. That information does not currently exist. We will get it!

·      The Open Space and Conservation Element requires this development to be set back 25 feet from the bank of the Creek. But it is setback only 25 feet from (what might be) the centerline of the Creek.


o   Again, remember, the City has not required the property owners to do a current survey, rendering the location of the Creek bank fictional.

o   Just weeks ago, for the project at 20592 Laguna Canyon Road (same specific plan, same zone) the City identified the setback as 25 feet from the bank.

o   Why is this massive apartment building allowed to push so close to the Creek and intrude on the environmentally sensitive habitat?

 
·      The Conditional Use Permit for the project expired. The required Planning Commission hearing on extension of the permit was never held. But almost a year after permit expiration, the City declared that the CUP was no longer expired! Friends of the Canyon is fighting this in court.


This project would set a precedent for the kind of development that can occur within the protected Specific Plan area on the bank of the Creek. We expect the City to play by the rules. Help us hold them to that standard.
