To Our Members and Fans,
Two weeks to flatten the curve….
Now here we are nearly nine months later and we are being told that we have to close up and shelter in place for a third time this year, according to Governor Newsom. Who decides who owns your body? Who decides who is essential? Who gets to control your business? Who gets to tell you to stay home? It’s time we stand up and fight so that we may decide what our communities look like, before we lose the ability to fight. Support our legal battle in the 9th Circuit Court of Appeals, and possibly SCOTUS, as we fight to make sure that your Bill of Rights are not violated any longer by governors who flout their own rules in our faces.
Our small businesses, which make up the character and heart and soul of our communities, are crumbling. According to FEMA, 40% of small businesses do not reopen following a disaster. The small business loans offered by the government are non-existent— and beside that, businesses don’t need LOANS, they need PROFITS. This pandemic has led to the greatest wealth transfer away for the middle class to the large big box stores and large online retailers. The people must be able to choose in a free society what is best for them and their families. The State does not have the authority to dispense the freedom to assembly at its own will.
If you’ve been following the news, you might have read or heard about our legal case to petition to open not only our business, but to open ALL gyms in the state of California. Fitness IS ESSENTIAL, not only for the body, but for the mind. The CDC ironically agrees with this, and recommends 150 minutes a week of vigorous (aka intense training) exercise. Fitness is also vital for boosting your immune system to combat viruses and illness. Additionally, we’re seeing reports in the news that suicide among the young is now sweeping the nation. We’ve lost some people we personally know in the industry to suicide during this lockdown.
But whether you agree and support our fight, or you are against it and would prefer to shelter, the reality is this— we do not know how much longer we can survive without opening. It is a deeply frightening and sad realization.
We cannot be forced to be shut down again. Our staff, their families, our vendors, landlords and the mental health and physical health of all our members will be at risk if we are forced to. We have countless testimonials in our lawsuit from members about how important the gym is for them, not just as a place to become stronger and healthier but also to achieve mental health.
What’s at Stake:
Many federal judges have made their position clear, and favor lockdowns, as they hide behind a very poor reading and interpretation of a 105-year-old Supreme Court case (Jacobson v. Massachusetts). If we don’t get the 9th or Supreme Court to recognize our natural rights as codified in the Bill of Rights in the Constitution, we can expect mandatory endless lockdowns, mandatory vaccines, travel restrictions, basically an endless dystopia… worse than the one we are living now.
Our bi-coastal legal team of Brian Chavez-Ochoa and James Henderson will be representing our company, and all of our interest as members in society.
We know it’s the holidays and things are tight. But Freedom isn’t free. It is expensive to fight for your rights. If you have anything to spare during this time of need, we will be beyond grateful.
The funds raised in this GoFundMe will go EXCLUSIVELY to pay our court fees and attorney’s fees in our lawsuit. Any remaining funds will be directly allocated to community redevelopment (aiding those businesses that were shut down and are struggling because they were declared “non-essential” by the government).
