fight greedy rich landlord

To be honest it is a bad location and at present waiting on my lawyers. We had water damage over a year ago landlord said use rent to fix it(thinking the would get paid), we had a total insurance claim of $110,000. After the insurance company(for the tanning salon that caused the leak) that only paid $21,000 to date. The building owner has a clause in the lease that they are not responsible. So the landlord realizing that the saloon's insurance wasn't paying they are coming after my business for the money. We entered into a reduced rent agreement in march, which i did not like because it was only a three month agreement, I kept saying to my lawyer the want to enter into this agreement because at the end they will have full control of my space. They did just that, sent a bill $48,000 in late fees and all the back rent that they have not received and have not credited me one single payment that i have made to them since the claim leaving me with a debit of $164,000. Which is insane. If I take of the 90k from the insurance short fall and the late fees that is 138k and the $30,000 that I paid them I am not even behind on my rent. They cant charge late fees due to the water damage. They waited til I was out of town to lock me out with a wrongful eviction. My agreement expired in june and have been asking for a new agreement to go forward, one email in june from landlord nothing since then. I will know more this week, but even if I get back in I don't know what they have taken out and i lost over $5,000 in food. My staff has been waiting but they cant go to much longer without pay. I will only use the funds for legeal fees, severance pay for my staff, and with some luck reopen the restaurant. If anyone helps and I recover damages I will gladly repay.them. Any amount helps
