On the night of September 27th after my weekly trip to the San Francisco Bike Kitchen while riding home with my girlfriend Molly I was in an altercation with a driver who had parked in the bike lane.
This happens to all of us on a daily basis riding in the city.
This time, the driver of the car tackled me off of my bycicle and proceeded to restrain and strangle me. I was being held to the ground face down with him on my back, restraining my arms and pressing on my throat. I attempted to remove him with no success, I feared for my life acted in self defense. This did not stop the attacking driver. At this time luckily a police car appeared on the scene, with the driver still on top of me.
After stopping the incident, and some deliberation - I was arrested with charges of assault with a deadly weapon. My bike, backpack, ulocks, and helmet were takin as evidence.
I spent 5 days in SF county jail and was released on OR with a request from the judge to take anger management courses.
Currently I am awaiting my trial which is set for November 1st. At that time we will find out if I will receive jail time or if the charges will be dropped/altered in any way.
Dealing with this has been one of the most stressful and difficult times in my life. The stress has not only been my own, this has affected many people in my life, my mother and my girlfriend have had an equally hard time dealing with the situation.
Between the loss of work and lawyer fees I have invested about $10,000 into this altercation and that will not be the end.
My hope is to not go to jail and to continue to raise awareness of cyclists rights.
