
Disabled access to a Public Right of Way

Hi, my name is Graham Stubbs, the father of a severely disabled son called Owen. He is 23yrs old and requires 24x7 care and is wheelchair bound. He used to use a Public Right of Way near our home in Blackrock, Co. Dublin. It enabled him to access bus stops and the N11 road. However, a few years ago a developer came along and has built a number of apartments and has put in big steps on the Public Right of Way which means that Owen no longer has access. This means that the route to transport for him is longer and my wife and I have to push him up a steeper hill on Newtownpark Avenue. We have pleaded with the developer and Dun Laoghaire Rathdown County Council to change their minds but to no avail. We now have to take a court case to vindicate Owens rights and the rights of everyone else with a disability or ambulatory challenge to access the Public Right of Way. This is expensive as it requires us to go to the Circuit and/or High court. In this day and age, this is crazy. If we win the case and Owen's costs are covered we will donate any amounts to the Irish Wheelchair Association. This is not about the money, it is about the right of some of our most vulnerable citizens to be protected from poor planning and development.
