UPDATE: after 14 years of battling the Banks I finely won. No big award because as I went thru my case Congress changed laws so I couldn’t peruse it in court as they changed the statue of limitations to months under where I was. It still pisses me off in 2021 the IRS audited me because when Wells Fargo sold the loan they finely applied my payments. So in 2008 the 1098 showed $18k now it shows $36k. I can’t go back and re file it was too long ago. In 2009 and 10 I didn’t claim any interest because I wasn’t making payments I was in court and started making payments in April 2011. But now Wells Fargo has my interest posted in those years. So for 2018 I claimed the amount of interest I “paid in that year” and ended up having to pay just over 8k to the IRS for Wells Fargo fraud. Since the statue of limitations ran out I can not peruse it. Other than that I’m glad I’m done fighting. But it was way worth it.

I was given a predatory pick a pay loan from World Savings in December of 2006. In March of 2009 the bank started to return my payments. In October of 2009 the bank now Wachovia put a notice if default on my door. I was in process of a modification but it was denied. I had tried numerous modifications, call every bank and lender trying to get refinanced yet Wells Fargo now my lender world not modify my predatory loan. I was in a lawsuit for the fraud on my loan which kept the bank from auctioning my home but after the judge gave Wells Fargo a extension on a demur he didn't extend the stop sale. We tried to get a TRO but the other judge denied it, forcing me to file chapter 13 to stop the sale of the home. I have been making payment in chapter 13 but they are based on a modification Wells Fargo is sure to deny. I have tried everything I can in my powers to work with the banks. They make more money if they foreclose on my home. I am counting on people who are mad enough at the banks to make a change in the way we make home loans. I think most people can spare $5.00 and if I can get 140,000 people to loan me $5.00 I can pay off Wells Fargo and pay everyone back.
