Thousands of people from the Urabá region of Colombia are suing the Chiquita banana company for paying right-wing paramilitary groups that killed their husbands and sons. We represent more than 2000 families who've lost loved ones in the conflict. The first trials will be in October of 2019 in this landmark human rights case.
In 2007, Chiquita Brands pled guilty to paying the Autodefensas Unidas de Colombia a total of $1.7 million dollars. It was a big victory for the Department of Justice, and the first prosecution of anyone for the crime of making financial transactions with a terrorist organization.
Shortly thereafter, attorney Paul Wolf went to Uraba, Colombia, to announce his intention to file a civil case against the company, on the part of family members of the victims. As word of the case spread, thousands of people eventually joined. For about half of the past ten years, we've had an office in Apartadó, and the same staff, serving more than 2,000 families.
Although we were the first, and are by far the largest group of plaintiffs, several large law firms are also involved, filing cases for their own clients. Unfortunately, they will not work with us, and we will have to pay all of the trial costs ourselves.
In late September - early October, we spent over $8,000 out of pocket to bring four "bellwether" plaintiffs to be deposed in Fort Lauderdale, FL. We have five more plaintiffs we'll have to bring, and would also like to bring their witnesses. The court has just granted our motion to take the depostions of three key witnesses in prison in Colombia. To do that, we'll have to bring a court reporter, translator, and a videographer from the United States. Then we anticipate bringing 15-20 witnesses to the trial in October of 2019. That's all we need your money for - travel costs for witnesses.
We're not a nonprofit. Our agreement with the clients is to cover the costs, and receive one third of any recovery. We've covered those costs for ten years already. Now we are in the homestretch, and need your help to make sure we can really do this. Many thousands of people could be lifted from poverty with this effort. We are recognized throughout the region as already having made a significant contribution to ending the conflict, which is our other goal.
