Violent Occupation of the Town of Caledonia


Starting in 2006 Native protesters from Six Nations violently occupied sections of Caledonia. Dozens of OPP officers were hospitalized, the local power station was fire bombed, groups of masked Native protesters roamed the town harassing and threating residents. Throughout 2006 the Ontario government and the OPP took a hands-off approach to this ongoing violence. Millions of dollars were given to individual Native protesters to pay them off to stop committing crimes against the residents in Caledonia.

Peaceful Citizens with Canadian Flags

In response a small group of citizens concerned about the rights of all Canadians decided to walk down the side of the road carrying Canadian flags. The OPP response was to repeatedly target any non-Native person for immediate arrest.

Sometimes the OPP claimed these citizens were trespassing by walking down the side of the road – people were arrested and taken to the OPP station and issued trespassing tickets. The photo attached is a group of 11 people arrested on one day for trespassing while walking on a county road with a Canadian flag.

At other times the OPP arrested non-Natives claiming they were obstructing police by walking with Canadian flags or people were arrested in order to prevent a breach of the peace.

At all times these citizens were peaceful while Native protester repeatedly committed criminal acts including violent crimes which the OPP would not step in and prevent.

OPP use Force against Randy Fleming

Randy Fleming had been targeted several times to be arrested for walking with a Canadian flag. The OPP were more than wiling to use extreme force against non-Native citizens who carried Canadian flags.

In 2009 the OPP used extreme force against Randy Fleming as he walked down the road with a Canadian flag. The six OPP officers who forced Mr. Fleming to the ground caused permanent damage to Mr. Fleming’s shoulder.

Mr. Fleming has sued the Ontario government over their racist policing policy of allowing violent criminal acts by Native protesters but targeting peaceful lawful citizens who carry Canadian flags.

Ongoing Legal Costs

Mr. Fleming has sued, so have other people who were targeted, and the government has endless taxpayers’ money to fight to ensure average citizens do not have rights in Canada.

So far, Mr. Fleming has expenses over $400,000 in legal costs and must decide whether to appeal to the Supreme Court to ensure everyone’s rights in Canada.

It will take $50,000+ to go to the Supreme Court of Canada.

Gary McHale is the organizer of this account and the founder of CANACE (Canadian Advocates for Charter Equality). Mr. Fleming was arrested at Mr. McHale's flag raising rally in Caledonia. Mr. McHale and Mr. Fleming are co-plaintiffs in one lawsuit against Ontario Government.

Mr. Fleming is the sole plaintiff in two other lawsuits against the Ontario government including the one that was appealed to the Ontario Court of Appeal - the subject of the National Post story listed above.

All funds raised will be withdrawn by Gary McHale and paid directly to Randy Fleming, his lawyer or directly to the court to cover Mr. Fleming's court fees. These fees and costs are directly related to Randy Flemings' Superior Court lawsuit that was appealed to Ontario Court of Appeal and his bid to appeal to the Supreme Court of Canada.
