custody of grandchildren

Hello everyone,
I'm not sure how to write this or ask for help so help me God.
Our grandchildren (Nikola 5, Kipprian 3)were taken by the state of Oregon due to neglect of both parents. State refuses to release them to our (grandparents) care because of spouses criminal history 10+years ago even though we are in a proccess of expunging it from the record. The DHS told us that even though we get it expunged (certified) that they "feel" its in best interest of the boys that we dont get custody of them. In other words the DHS is telling us nicely "NO", no matter what, we tried every option. The boys lived most of thier lives with us and only home they know. Those boys are now in foster care with strangers, not only that they were taken from their family they were also split up to different homes. They are being moved from one home to another and that is greatly affecting their self esteem.
We just spoke to Nikola on the phone and all that boy could say was how no one loves him anymore and he doesnt have a brother anymore, Kipprian is becoming unresponsive to his feelings. They are both shutting down and we cant do anything about it from afar. It broke our hearts into pieces to hear that from a 5yr older or watch a 3yr older slip slowly away. Please help us help the boys, and bring them home.
We are getting a lawyer to help us get those boys back home as soon as possible but the case is going to cost us a pretty good penny that we are unable to do so at this time. The lawyer believes that we have a good case on our hands.
