Breathe Free Colorado was founded to stop the unconstitutional mask mandate created by Governor Jared Polis through executive order. In July of 2020, Donna Walter and Mark Milliman filed a lawsuit in U.S. Federal District Court against Polis/State of Colorado, Boulder County Public Health, and the City of Fort Collins stating their mandates were unconstitutional. After months and months of legal wrangling and delays, we called their bluff to push the case forward. On July 8th of this year Polis ended the Emergency Declaration terminating the mandatory mask mandate. Behind the scenes he enacted a disaster declaration on the same day to keep some of his powers a while longer. At that point our lawsuit became moot so the court dismissed the case without prejudice that means that we can refile it at any time. It took almost a year to get to this point but we did exert pressure to end the craziness, but the control game is not over. They won't let it be over!
Because of the so-called Delta variant, Colorado is seeing a rise in cases again. Evidence for this rise is pointing to vaccinating people in the middle of a pandemic so the SARS-CoV-2 virus ends up mutating to resist any vaccine along with unproven non pharmaceutical interventions like social distancing, lockdowns, and masks. This rise in cases, and not deaths, is causing CDPHE and local health departments to ramp up their control again even though they don't have legal authority. The first step in this escalation is forcing our kids to wear masks in school. Polis and CDPHE pushed the order behind the scenes through local health departments. They reasoned that masks will reduce hospitalizations for kids but offered not scientific proof. Cases alone does not tell the whole story. Arbitrary and capricious mandates were hastily implemented by all county health departments forcing school districts to continue the psychological operations on our kids. Not only is there no medical rationale behind masking our kids there is no legal basis as well.
The next step is for CDPHE...and Polis...to start forcing vaccines. First for government employees then for professionals licensed by the government (DORA). "If you don't comply enough, then we will force masks on everyone followed by passports." is their montra. Eventually they want to force everyone to be vaccinated with no medical rationale or credit given to natural immunity.
We see the writing on the wall. Actually we have the slides from Boulder County Public Health with the plan. We saw how they could deny justice in the court system though delays so we will pivot and challenge them in other ways. The power of protest to elected officials can be more effective than any judge. We want to organize en mass and protest at school boards, county commissioner, board of health, and any other meeting where the government wants to take away our freedom to make our own health care decisions. Numbers matter. We created Freedom Strike (freedomstrike.net and freedomstrike.org) where the people of Colorado can gather, discuss, and organize against the unreasonable edicts thrust on us. Legal action is still part of our strategy. We are working with different groups to file various lawsuits against these new unlawful mandates. Our next lawsuit will be against the unlawful Public Health Order 2120-7 issued by Boulder County Public Health forcing our kids to wear masks in school. Boulder County is the nexxus for all of this activity which is why we will start here with our litigation. The barrier for the retainer is quite high which is why we increased our goal. Until now our legal counsel has keep his expenses at a minimum because most of his fine work has been pro bono. Any future lawsuits may involve different counsel that will charge the group. Our overhead expenses for the website and social media servers is low, but we will need much more money for outside counsel. They money that you've already donated will go to those causes along with any new contributions that come. We are greatly appreciative for the trust that you've given us and will continue to fight for responsible public health policy.
