The neighbors have been battling the developer for over 20 years to stop the development of ingress and egress off of Versaggi into the two commercial properties at the top of the street. This is the ONLY ingress and egress for the 90 homes in this subdivision. Each commission over two decades has denied this access.
But two years ago, the commercial developer sued the city because they inaccurately asked him to remove campaign signage on his property. He sued the city for violating his freedom of speech and he won. He settled with the city by asking for the ingress into one of the properties and to allow the new driveways at the second commercial property in two years -- now.
At the December 7th commission meeting, the commissions voted yes after the city attorney said, we will be sued and lose again, and the city has no money.
Commissioner George asked planning and zoning if a traffic study had been completed or an accident report pulled. Planning and zoning responded that they had not done so. Commissioner George then stated we should really have those in cases like this. The commissioners then voted yes. Clearly, they voted out of fear of being sued and not for the protection and safety of the residents.
We are using this Go Fund Me account to raise money so that we can cover attorney's fees, court costs to effectively appeal this decision.
We are a neighborhood of families young and old. And, we have a strong sense of community and we are concerned about the safety of our residents.
