Appeal bad precedent set for Jeffco Tax Investors

The Jefferson County Circuit Court dismissed an investor's ejectment case on a 2013 tax deed. This tax deed was purchased over the counter, and the investor immediately filed for ejectment. The trial court dismissed the ejectment action because the tax deed was over 6 years old citing the Rioprop case. The judge did not toll the time that the tax deed was held by the state. If this holding stands, it will make over the counter tax deeds in Alabama that are over 6 years old worthless because the court will not grant an ejectment! This bad precedent needs to be overturned to protect tax sales investors!

The tax deed that the investor purchased was her first tax deed investment. She is having trouble coming up with the money to fund this lawsuit. This lawsuit is of significance to any Alabama tax sale investor, so we all need to come together because this matters to all of us! If this decision isn't challenged this bad precedent will be the status quo!
