We are gathering litigation funds to challenge Facebook’s censorship and bad faith curation of the public square in violation of the First Amendment to the United States Constitution due to it functioning as an agent for governments including the WHO, public health agencies and the US Congress.
Facebook has monopolized the American public square in violation of Section 2 of the Sherman Act and serially violates its good faith curation obligations under FCC Section 230. In exchange for being permitted to abuse its privileges and maintain it’s monopoly power, Facebook put the World Health Organization in charge of its social media monopoly as it relates to public health. This served Americans poorly, but particularly elected officials of all stripes who were let down by the nation's experts while they were entrapped in the Facebook echo chamber as well.
The US government can’t outsource enforcement to a social media platform to censor free speech that it would be prohibited from engaging in itself, particularly when it places an international government body, the WHO, on whose behalf Facebook moderates the American public square.
We have a civil rights law firm preparing a vanilla complaint to be presented to a syndicate of plaintiff’s law firms for filing in the Northern District is California. This litigation will be extraordinarily expensive—we estimate it will ultimately cost $5-10 million—and the funds the FormerFedsGroup Freedom Foundation raises will help fund costs and fees that including expert fees in this and other protection actions to protect civil liberties and fundamental rights like the First Amendment rights to free expression.
