Georgia’s very limited medical cannabis law only provides protection from prosecution if a qualified patient possesses a legal amount of oil. There is no provision in Georgia law that suggests how a patient might actually obtain medical marijuana. In summary: Georgia’s medical marijuana law does not legalize the production or sale of medical cannabis. Representative Allen Peake has sponsored a bill to remedy this. And Crohn's Disease has since been approved by the Georgia legislature. Chronic pain is sure to be approved soon since it is the number ! ailment. But Scott and David were caught up in the legal crosshairs.
Scott Negron is a former highly decorated fire fighter from California and Florida who has led an eclectic life. He is a musician, buissnessman, medical cannabis activist, and a father. For over twenty years, he has suffered from chronic pain and Crohn’s Disease. On a pain scale of 1 to 10, Scott's pain level was 8 or 9 most times. In 2010, Scott started to treat his chronic pain and Crohn's disease successfully with medical cannabis. The cannabis plant renewed Scott's health and happiness. His body regenerated and healed. He stopped laying in bed groaning and participated in everyday activities again. He renewed his music career and started the Atlanta band, the Harddonuts.
David Mazurek has been Scott’s caregiver. Prior to that he served as a caregiver for Scott’s grandparents. David has never smoked cannabis.
In February 2015, Cobb police raided Scott and David's home and confiscated all the medical cannabis, Scott’s treatment. They were charged with “Trafficking”, a felony that carries a mandatory minimum prison sentence if convicted, with no maximum and a $100,000 fine. O.C.G.A. 16-13-31(c)(1) The search warrant was defective. The officers violated their curtilage. The State falsely and fraudulently doubled the amount of medical cannabis by weighing STEMS and other material not allowed under Georgia statue. Their was no trafficking, no victims, no violence, no enrichment and No Mens Rea (no guilty mind).
The legal struggle has been going on for two and a half years. It has been draining financially, physically and emotionally for David and Scott. David received a nolle prosequi. Scott accepted a plea bargain and was sentenced to 1.5 years plus 10 probation. His max release date Is March, 2018. He is now branded a criminal having never been convicted before. He accepted the plea bargain because he was threatened and coerced with a 35 year plus prison term. Scott respected the first Assistant District Attorney on the case. He was fair and honest. The second ADA was like a mad ravenous dog and used any means neccessary to force Negron into prison. And the Judge, Adell Grubbs, violated due process and Scott's constitutional rights. She understood nada about medical cannabis She and the ADA never once allowed Scott a medical neccessity defense. The State has a goal to ruin the lives of medical cannabis paitients like Negron in their drug war to ensure their wins or victories. Scott is currently serving his prison term at Coastal State Prison, Savannah Georgia.

Scott is pursuing legal action against Cobb County. His legal options include filing a habeas corpus, Writ of Prohibition, and a Sentencing Modification.
Scott may incur expenses for Curt and Catherine working on his behalf with the State Board of Pardons and Parole.
