We cannot allow setting a precedent of overriding Midtown Historic Conservation Guidelines, which will weaken or nullify the validity of 12 similar standards in other Midtown Historic Districts.

Background: About 7 acres of land at the eastern corners of Sam Cooper Boulevard and East Parkway were purchased in late 2015 by Makowsky, Ringel and Greenberg, LLC (MRG). This is directly across from Overton Park, where the beautiful bicycle arch is located.

The property is in the Lea’s Woods Historic Conservation District.

Our historical standards state on p. 6, under NEW CONSTRUCTION andADDITIONS:
“New construction should be consistent with the architecture and period-styling of the existing buildings along a street in terms of height, scale, setback and rhythm”.


Problem Statements:
MRG’s planned development applications to the Land Use Control board is in direct conflict with Lea’s Woods Historic Conservation Standards, because they intend to build 3, 4 and 5 story buildings. There are no apartment complexes or other buildings with a height over 2 stories within the area, or nearby.

If MRG overrides Lea’s Woods Historic standards, it will set a precedent that all other Midtown Historic Districts standards, 13 in total will be weakened or worthless. This could lead to rampant violations by developers and result in lowered property values and quality for homeowners.

Funding Needs:
We retained excellent legal representation to ensure we do everything possible to prevent our historic district guidelines from being overridden by MRG. This includes having advice and representation at the June 8th hearing of MRG’s application of planned development with the Land Use Control Board, and the subsequent City Council meeting (date TBD).

We are actively engaged in lobbying all key stakeholders and will be submitting a petition to City Council, which should also include signatures from board members of other Midtown community groups that have similar Historic District Guidelines.
