Victim of Vicious Pit Bull Attack

On June 29th, my husband Hal and I were watching television in our room, my roommate Jonathan James (known as JJ) Mayer comes to the door and asks my husband to come and attempt to start the lawn mower. My husband no sooner touches the lawn mower and the dog attacks. It took 3 grown men to get the dog off my husband. My husband has now been hospitalized, at Richardson Methodist at Renner and Bush, going on 3 weeks because of these injuries.

Plano Police Department has done an investigation and they have concluded that this was not a malicious act. While the roommate has admitted to riling the dog up, and said "I told Hal not to touch the lawn mower, because Rocko (the pit bull) was agitated from him attempting to start it". Though my husband says no such warning was voiced. If he knew that the dog was agitated and likely to attack, why did he get my husband to try to start the mower, without at least restraining the dog, or putting him up in his room? Also, in the roommate affidavit to animal control his stated that the dog attacked from his fear of motorized lawn equipment. This raises questions i need answered as well. How does he know thats why the dog attacked? Is there previous knowledge the dog had a fear? If yes, then why ask my husband to try the lawn mower? If no, then how can he know thats why the dog attacked, unless he himself was witness to the dogs agitation when he was outside before coming to get my husband? The roommate and my husband have a history of animosity, and were constantly getting into heated arguments, in fact, they got in an argument earlier that morning over the very lawn mower that this attack centered around. One of the reasons given to me as to why the act wasn't malicious from a Collin County prosecutor was Mr. Mayer's love for the dog. Really?

I am simply asking for answers to these logical questions from above, I would think that a determination of whether or not this was a malicious act can not be determined until they are.

Now with time out of work, and medical bills mounting, legal fees around the corner, we need a little bit of a miracle.
