Im am a US ARMY Service Connected Disabled Veteran, In 2007 I took a mortgage out for 80 thousand on my home to add on and make renovations for a growing family. In November 2010 I sent in a large payment. In May 2011 we found out our mortgage company missallocated our funds and by July 2011 filed for a forclosure on our home. I called my attorney, who filed an injuction and stopped the forclosure. Through court orders we requested and finally in 2012 received a breakdown on the monies that we sent to Saxxon in 2010. RCS sent us a letter admitting that Saxxon misappropriated the funds by placing them in a suspence account and then later misappropriated the funds. They also advised that even though Saxxon misappropriated the funds that I now owe any and all attorneys fee's, late fee's, etc.. associated with this, to include the new foreclosure costs, and subsequently filed forclosure papers. Our loan has been sold several more time since 2013 and we have taken the same actions each time with each new lender. This has been draining us financially. Here we are in 2017 and we finally get paperwork in front of a judge for a preliminary hearing with all financial institutions involved listed in the suit, and the judge throws out all request for damages to my credit, emotional damages stating that, we have been able to live in the home so we acquired no real damages, nor damages for higher interest on vehicles etc because of the damage they have caused to my credit score. The only things which was allowed was the wrongful seizure and unfair debt collection practises and some damages associated which typically only award around $7,500. The finance company now says my 74,000.00 balance in 2010, is now over $186,000. Due to late fee's, penalties, attorneys fee's, forclosure costs, accrued intetest on the loan, etc..My wife and I are asking for donations to finnish fighting this wrongful seizure and save our home.
