In August of last year we worked with a very diligent responsible 1st time home buyer. He called the lender on each house of interest to determine what the payment would be. Asking the lender to pull the tax bill and be as accurate as possible. The lender was on point with each one.

The Buyer selected a house, got the offer accepted and went to closing. The taxes on the tax bill showed approx 1100 dollars a year. When the tax bill came out in Nov 2017, and the lender who were paying the taxes on behalf of the Buyer, discovered they were $2000 short....... Well if they are 2000 short for last year they will be $2000 short for next year they need to collect $4000 between the Feb 1 payment and the Oct 1 payment.
What?? His payment has just gone up almost $500 a month, but why what did we miss? He asked all the right questions. As it turns out the seller has used PACE energy assessment financing to put a roof on the house. A roof that was overcharged by 100%. an 1800 sq ft rectangle without any interesting roof lines was $22,000 dollars. It was not on the tax bill yet. The total cost of the roof is $40,000. HOW? $2000 a year for 20 years?

Was it laced in gold you ask? The buyer wishes. we have recently discovered that this PACE assessment showed up on the title commitment as a requirement and as an exception. The attorney who closed it is human and missed it. Sadly that does not help the buyer. The seller was negligent and did not disclose.
The closing attorney has refused to assist with minimally getting the tax prorations addressed with the seller owing the buyer for the shortage in 2017. The Buyer cannot make a payment that has increased by almost 50%. You cannot make a partial payment. The Buyer also does not have enough money to get an attorney to sue the Seller for non disclosure or the Closing Agent for negligence.
