Bredhurst Parish Council takes Maidstone Borough Council to the High Court

Bredhurst Parish Council is taking High Court action against Maidstone Borough Council (MBC) following MBC’s decision to adopt their Local Plan, which includes 2000 houses at Lidsing. This would see houses built with shamefully inadequate infrastructure and the destruction of neighbourhoods, countryside and wildlife.

Despite strong opposition from Bredhurst Parish Council, campaign group Against Lidsing Garden Development (ALGD), KCC and Medway Council, MBC recently voted 31:21 in favour of adopting the Conservative led Local Plan. Opposition Cllrs spoke against adoption of the Plan, but the Conservative Leader of MBC said, ‘a bad plan is better than no plan’.

Following extensive legal advice, BPC has commenced High Court action against MBC. BPC are very grateful for strong support and advice from London based Landmark Chambers and Solicitors, Leigh Day, who have offered their services at a hugely discounted rate allowing BPC to proceed with legal action. However, they still need to raise about £35,000.

They have raised similar amounts before for legal representation throughout the Plan examination process but are now asking the public again for donations to support their latest action. Taking a local authority to the High Court is a massive undertaking, especially for BPC which is a tiny Parish Council. They know how much all residents in the area are against the development at Lidsing and, with your support, MBC’s decision will be challenged in the High Court

There is a similar High Court challenge from Save Our Heathlands who are opposing 5000 houses at Lenham. BPC have worked closely with Lenham colleagues for several years. If both or either challenge succeeds, MBC would need to re-think its Local Plan.

The fight to stop unsuitable development from destroying our area is far from over.
