<div>Die Generalstaatsanwaltschaft München hat nun Anklage gegen "Die Letzte Generation" als vermeintlich kriminelle Vereinigung nach § 129 StGB erhoben. Dies ist ein gefährlicher Präzedenzfall für die Kriminalisierung friedlicher Klimaproteste und ein massiver Eingriff in die Grund- und Menschenrechte der Meinungs-, Versammlungs- und Vereinigungsfreiheit. Um sich juristisch wehren zu können, brauchen die Angeklagten erfahrene Verteidiger*innen. Doch ohne finanzielle Unterstützung ist eine angemessene Verteidigung kaum möglich.

<div>Der <a href="https://umwelt-treuhandfonds.de/" target="_blank" rel="noreferrer noopener"><strong>Umwelt-Treuhandfonds</strong></a><strong> (UTF)</strong> als bewegungsübergreifender Rechtshilfefonds für Klimaaktivist*innen sammelt daher Spenden, um die Verteidigungskosten zu decken und sicherzustellen, dass die Betroffenen nicht schutzlos diesem Verfahren ausgesetzt sind.

<div><strong>Wie hoch sind die Verfahrenskosten?</strong>

<div>Die Kosten schließen die für eine gute Verteidigung in einem solchen Verfahren nötige Doppelverteidigung je Angeklagter*m sowie ein Honorar für die umfangreiche Vorbereitung ein.

<li><strong>Vorbereitungskosten pro Anwält*in:</strong> 5.000 Euro
</li>
<li><strong>Honorar pro Anwält*in pro Verhandlungstag:</strong> 500 Euro
</li>
<li><strong>Gesamthonorar pro Anwält*in (bei 40 Verhandlungstagen):</strong> 5.000 Euro + (40 Tage × 500 Euro) = 25.000 Euro
</li>
<li><strong>Gesamtkosten für fünf Angeklagte mit je zwei Anwält*innen:</strong> 2 × 25.000 Euro × 5 = <strong>250.000 Euro</strong>

<div>Am dringendsten benötigt werden die <strong>50.000 Euro</strong> Vorbereitungskosten. Auch in Neuruppin und Flensburg laufen ähnliche Verfahren, für die weitere Kosten entstehen.

<div><strong>Warum ist das wichtig?</strong>

<div>Die Anwendung von §129 StGB auf eine gewaltfreie Klimabewegung ist beispiellos. Sollte nur eine Person verurteilt werden, könnte dies bedeuten, dass die gesamte Bewegung als "kriminelle Vereinigung" gilt – mit massiven Folgen für alle Beteiligten und Unterstützer*innen.

<div><strong>Das kritisieren auch die UN!</strong>

<div>Gleich <strong>fünf UN-Sonderberichterstatter*innen</strong> äußern in einem gemeinsamen Brief an die Bundesregierung starke Bedenken gegen die Anklage und kritisieren das Vorgehen der Ermittlungsbehörden. Sie sehen in der Verfolgung der “Letzten Generation” als kriminelle Vereinigung einen Missbrauch des Straftatbestands zur Sanktion von zivilem Ungehorsam und darin eine Gefahr für die Meinungs-, Vereinigungs- und Versammlungsfreiheit <a href="https://spcommreports.ohchr.org/TMResultsBase/DownLoadPublicCommunicationFile?gId=29390" target="_blank" rel="noreferrer noopener">in Deutschland</a>.

<div>The Munich General Prosecutor’s Office has now filed charges against “Letzte Generation” under § 129 of the German Criminal Code, labeling the movement as a so-called criminal organization. This sets a dangerous precedent for the criminalization of peaceful climate protests and constitutes a massive infringement on fundamental human rights, including freedom of speech, assembly, and association. To defend themselves legally, the accused need experienced lawyers. However, without financial support, an adequate defense is nearly impossible.

<div>The <a href="https://umwelt-treuhandfonds.de/" target="_blank" rel="noreferrer noopener"><strong>Umwelt-Treuhandfonds</strong></a><strong> (UTF)</strong>, a cross-movement legal aid fund for climate activists, is collecting donations to cover legal defense costs and ensure that those affected are not left defenseless in this trial.

<div>The costs include the necessary dual legal representation for each defendant, as well as fees for extensive case preparation.

<div>No fewer than <strong>five UN Special Rapporteurs</strong> have expressed serious concerns in a joint letter to the German government, criticizing the prosecution’s approach. They see the pursuit of “Letzte Generation” as a criminal organization as an abuse of § 129 to punish civil disobedience – posing a grave threat to freedom of speech, association, and assembly <a href="https://spcommreports.ohchr.org/TMResultsBase/DownLoadPublicCommunicationFile?gId=29390" target="_blank" rel="noreferrer noopener">in Germany</a> .
