Family & Friends of Unfairly-Jailed Inmate Ask For Help to Rebuild His Life

Most of the time, the justice system gets it right. But, as we are all
becoming more and more aware, sometimes it gets it very wrong.
Daniel Smith's family is another one of those tragic examples of how
big government's over breadth and attack on personal freedom can
impact us all.

Thousands, whose quality of life were positively impacted by Daniel's
humanitarian efforts, sought support from Congress on his behalf in
2015 [1].

After a trial in which Daniel was denied the right to present a case in defense, 
a petition with thousands of signers sought leniency from the judge [2].

In early 2017, thousands petitioned the President to grant a stay for Daniel [3].

In late 2017 thousands again rallied to implore the Ninth Circuit Court of Appeals 
to take notice of errors and correct a miscarriage in justice [4].

With the exception of a somewhat lenient sentence, all of these public outcries
were ignored by the powers that be.

Beloved of thousands around the globe for his heroic activism and
inspiring attitude against all odds, Daniel will finally be released from
prison to a halfway house on July 2nd.

Now, over three years later, after serving the majority of his sentence, new counsel
helps the Supreme Court see how Daniel committed no crime, the government
egregiously misapplied law, and the court denied due process. [5]  It will take several
months to sort out.

Though Daniel will already be freed when this appeal is heard we all hope the
Justices do rule in his favor so his prior unblemished name can be restored.

In the meanwhile, crucial financial support for Daniel and his family is sorely needed as it will
take a number of months before Daniel can adequately support his family again.
This caring,  compassionate and giving man was tragically separated from his wife, two
daughters, two sons, and a grandson for more than three years -- simply for helping
others. We pray you'll see fit to help Daniel and his family now in this rebuilding time.

Daniel Is Out Of Prison:

Daniel is now in custody at a Halfway House in Spokane. He has about 10 more days before he’ll transfer to custody in his home. Though he’ll finally be back home with Karis and Sabby the Bureau of Prisons (BOP) still controls his every move. Thus he has to give one week’s notice to request leaving the apartment: like for a job interview, going to church, shopping, or having someone visit, etc.

This custodial monitoring will last for five and a half (5 1/2) more months ~ probably until shortly after New Years 2019. Finally then he’ll be free other than reporting to his Parole Officer ~ for 4 additional years.

Supreme Court Appeal Update:

Daniel’s attorney emailed:

"The Supreme Court is scheduled to conference Mr. Smith’s case on September 24. There is a possibility for one of three things to occur: (1) They could order the government to respond to the petition and make a decision after that (if a response is filed, the reply must be filed within 10 days and the Court needed not wait to consider the reply); (2) they could grant the petition on any or all questions raised; or (3) they could deny the petition for no reason at all. There are over 10,000 petitions filed each year, and out of those petitions, the Court only grants about 80 per year."

FDA Debars Daniel For Life:

Though Daniel is on the way to a fresh new life the Food and Drug Administration is not wanting to leave him alone. They published an unbelievable blockade for his future in the National Archives, Federal Register. The Daily Journal of the United States Government:
"The U.S. Food and Drug Administration (FDA or Agency) is issuing an order under the Federal Food, Drug, and Cosmetic Act (the FD&C Act) permanently debarring Louis Daniel Smith from providing services in any capacity to a person that has an approved or pending drug product application."

Important Questions ~

Has Daniel Found Work Yet?

No! The BOP runs the Halfway House and retains strict control over each and every attempt to do so. He must ask one week in advance to go job hunting or, for that matter, to leave the Halfway House at all.

Will he be able to earn enough income to support himself and his family?

He is more than capable and wants to pursue several types of work. But the BOP has already precluded him from working at several of his most qualified and desired positions.

Some have asked again: Why aren’t there Federal programs to help released felons re-enter society?

The brief answer is: There are such programs: by both the Dept of Justice and Dept of Labor to help released felons re-enter society successfully. BUT Congress so under-funded these programs that there are zero grants available. (I verified this again.)

How about State and or Private Re-entry programs?

Washington State only helps felons guilty of State crimes. (Daniel’s were Federal). The Justice Department warns against trying "any private re-entry programs as there are many scams going on, ~ as many re-entry felons have tragically learned."

What will it take financially to help Daniel get through this transition time?

I know you folks will do your best to meet his necessary finances. ~ as you’ve always done. What is so shocking to me is how expensive everything is today. In 1967 I purchased my first home for $3,000. When McDonalds first came to the Pacific Northwest a hamburger, fries & a milkshake cost $1.00. True story!!

It is critical that he receives enough help to get a fresh start ~ particularly since the Feds are strictly controling everthing he does for the first six (6) months. It will be very difficult, to say the least, during this time.

Daniel compiled a minimum budget needed to make it until the Feds grant him more freedom. He is disappointed that many types of work for which he is qualified have been rejected by the BOP. Plus that Lifetime Ban the FDA imposed hinders him.

Partial freedom...but still controlled by the Feds.

Daniel appreciates your help for giving him a fresh new start in his life. Wrongfully not allowed to put on a defense at his trial ~ he'll be out months early (July 2nd) because he had perfect behavior - zero problems in over 3 years in the Federal Penitentiary. He will build a new life and will always live to help others.
