Aufsichtsbeschwerde gegen den Gemeinderat Stäfa

Seit 1997 wohne und arbeite ich in einer grossen selbst umgebauten Loft in Stäfa am schönen Zürichsee.
Damals waren in Lofts umgebaute Industrieräume in der Schweiz noch nicht so bekannt. Entsprechend waren die Reaktionen der anderen Eigentümer im sogenannten Gewerbezentrum mitten in Stäfa.
Mittlerweile bin ich Besitzerin von zwei Stockwerkeinheiten. Die Liegenschaft ist der Industriezone zugeordnet, weil es sich um die vormalige Produktionsstätte der weltbekannten Mettler-Toledo Präzisionswaagen handelt. Industrielle Produktion gibt es jedoch keine mehr. Es sind in erster Linie Kleingewerbe und Dienstleistungsbetriebe, die hier arbeiten.
Bevor ich die erste Stockwerkeinheit kaufte, machte ich eine Baueingabe, die mir inklusive Wohnrecht bewilligt wurde.
In jedem Industriegebäude ist eine Wohnung zugelassen. Ueber die Jahre hat es sich auch gezeigt, dass es sinnvoll ist, wenn jemand im Gebäude wohnt. Einmal geschah es, dass mein Nachbar im Untergeschoss einen Wasserhahn nicht zugedreht hatte. Es gab eine Ueberschwemmung. Ich rief die Feuerwehr.
Leider war meine etwas ungewöhnliche Wohn- und Arbeitssituation in den letzten 21 Jahren jedoch kein Sonntagsspaziergang.
So habe ich über die Festtage 2018 eine Chronik meiner Geschichte mit den Behörden der Gemeinde Stäfa geschrieben. Originaldokumente sind nun öffentlich einsehbar.

Für mich zählt jedoch, was dort passiert, wo ich lebe.
Wer sich in Stäfa etwas umhört weiss, dass ich bei weitem nicht die einzige Bürgerin bin, welche die eher eigenartige Auslegung von Recht und Gesetz durch unsere Behörden erfahren hat.
Am 8. Februar 2019 hat mein Anwalt bei der Baudirektion des Kantons Zürich eine Aufsichtsbeschwerde eingereicht.
Solange Bürger einzeln und im Privaten mit den Behörden zu tun haben, können sich Amtsstellen so allerhand erlauben!!! Es herrscht eine gewisse Vorsicht oder eher Angst, sich zu wehren. Man könnte ja dann ein anderes Mal, wenn man wieder ein Bauanliegen hat, Repressionen zu spüren bekommen.
Ich erhoffe mir, dass die Veröffentlichung meiner Erfahrungen und originaler Dokumente, sowie die Aufsichtsbeschwerde gegen den Gemeinderat mehr Gerechtigkeit zur Folge haben werden.
Es versteht sich von selbst, dass die Arbeit des Anwaltes teuer ist. Deshalb habe ich mich entschieden diese Kampagne zu starten.

It was in 1997 when I moved into my big and airy loft in Stäfa on Lake Zurich. I converted the industrial space into a living and working situation, just like I had experienced lofts in New York since the eighties.
At the time the concept of lofts was not widely known in Switzerland. Other owners in the building eyed me and my project with suspicion.
Over the years I bought a second unit. I own a whole floor in the former production place of the world famous Mettler-Toledo precision scales. Despite the fact that the building is in the center of town it is still classified as industry on the town zonal plan. However no industrial production takes place in the large complex nowadays.
Back in 1997 I made sure that all permissions were in place before I signed the contract and purchased the unit. From the very beginning I had been granted the permission to live in my space.
Basically every industrial building can have one residential unit. Over the years this rules proved to make a lot of sense. Once I discovered a flood in the basement. It was 10 pm. I called the fire brigade...
Unfortunately, I have to admit, that my unconventional living and working situation had not been a "Sunday walk" - as we say.
Over the holidays at the end of 2018 I wrote a chronicle with original documents and published it on my website.

Many people tell me that what happens in Stäfa happens in many small towns.
That, however, does not make it easier for me. I live in Stäfa. What happens here is vital for me.
And: I am by far not the only one who experienced irregularities and unequal interpretations of law and order by the local authorities in Stäfa.
On Februray 8th 2019 my lawyer handed in a detailed complaint with the construction department of the Canton of Zurich requesting an audit and indepth investigation.
As long as we all fight alone and keep our experience with our town administration private, we run the risk of facing "remarkable" things. Many fear that speaking up would lead to future repressions.
I hope that by making my story public and online accessible, authorities will investigate thoroughly into the matter.
It goes without saying that the work of a lawyer has to be paid.
I do hope to get financial support on this platform. Every small contribution counts.
