Jeff and Avi are young and in love. And they are enduring the longest battle with the Australian Government for their right to be together.

Let me explain.

Jeff is an Australian citizen, born and breed. Avi is from India. They met in 2009 when Avi was in Australia on a temporary visa. Due to some previous (bad) professional advice, Avi had to leave Australia to lodge a partner visa application at the Australian High Commission in India.

The Australian Government waited two years to even look at their application. Then almost right away the Government throws out their partner visa application for the most absurd reasons:

Jeff and Avi have a joint Australian bank account. Avi was accessing money from India. The Australian Government rejected their Commonwealth Bank statements and said those statements did not prove it was Avi who was withdrawing the money.  

Jeff and Avi communicate every day using a range of apps. The Australian Government rejected their call logs and said those records did not prove that Jeff was speaking with Avi (and vice versa). 

Jeff has been the sole bread winner for the past five years. Their immigration applications have cost thousands, approaching $50 000. Jeff is supporting Avi on a single income. The Australian Government rejected their financial evidence and said there was no indication that they had merged their finances together or shared day to day expenses. 

Jeff and Avi registered their relationship in 2015 in Australia. This union is legally recognised under Australian law. But the Australian Government rejected this evidence and said the couple have not demonstrated that they see this relationship as being long term.

The worst part is, the Australian Government said it had doubts about their relationship and dismissed the evidence. But then the Government never gave Jeff or Avi an opportunity to be interviewed by telephone or face to face to explain or challenge the Government's absurd conclusions.  This treatment goes against Australian laws and basic human rights, and is simply un-Australian.  

Jeff is stuck working in Australia to pay the ongoing legal bills to battle the Australian Government. Avi is stuck in India. They have been apart for 2.5 years already. They face another 1.5 years apart while the legal process goes through the motions.

Imagine that countries still exist today where homosexual acts between consenting adults is a criminal offence.  India is one of these countries.

Homosexual acts is illegal under section 377 of the Indian Penal Code. Indian society has an ingrained intolerance of homosexuality. Many news articles report the extent of discrimination, marginalisation, harassment, blackmail and physical violence toward the gay population. For these reasons, we cannot reveal Jeff and Avi’s true identity because Avi’s safety in India would be compromised.

I have joined their cause to fight for what’s fair. Please help me to help Jeff and Avi. Any donation big or small will help pay the Tribunal application fees, professional (legal) fees and if there’s any left over, travel costs so Jeff can travel to India to see Avi.

The Australian Government must answer for its oppressive and inhumane treatment of its citizens and its disregard for the rule of law. 

Same-sex marriage won the YES VOTE!
