We need your support to help us to fight against the unjust laws being enforced by President Trump and the Department of Justice Attorney General Jeff Sessions.  Recent changes to the administration and enforcement of immigration policy single-handedly modified by Jeff Sessions, is tearing families apart unjustly. This administration is destroying the lives of millions of innocent people. Enrique Gonzalez and I are taking a stand! We need your support to afford legal services, not only to win our fight to keep Enrique in the United States, but also to bring awareness to the injustice that is American immigration enforcement of this admin.

We had successfully been awarded two previous "Stay of Deportations" from the past administration. The most recent Stay was due for renewal in December of 2017. Unlike before, the Trump administration refused to renew the protective measure while also demanding that Enrique leave the country.  With a U.S. immigration approved marriage, and all legal documents in order up to this date, we see this as nothing more than targeting and refuse to back down on our fight for justice.

As a U.S. Citizen Spouse I (Harlon J. Wilson), have  constitutional rights that should enable us to receive a green card. The Trump Administration seeks to deport Enrique before we reach legalization - an effort with severe consequences as it would mean Enrique may not be permitted to return to the country for up to ten years. The process, the laws, the unjust treatment and unfair practices of this administration, including the enforcement arm of ICE, and the deportation force that is sweeping the nation, is unjust.  It is inhumane. The new regulations coming down from Jeff Sessions greatly prohibits judges from doing their job of hearing cases and executing judicial discretion. Judges are no longer permitted to award "Administrative Opens" nor "Administrative Closures," the two legal tools we need in order to stop the current deportation order.  In fact, common practice for asylum seekers is mass hearings with swift judgement. Due process, a constitutional right of both citizens and all people on U.S. Soil, often is not adhered to in the irrational practice of law executed by this administration.

The rights and freedoms of US Citizens and millions of undocumented who are stuck in the legal system awaiting their day in court, are being trampled on.  Week-after-week families are being destroyed. Like our case, Enrique may soon be incarcerated, held and moved around from one detention center to another with deplorable conditions (often including over crowding, lack of beds and daily comforts, access to medical care, and basic essentials, etc.).  This, after our nation empowered him to be present for more than a decade, is truly unthinkable.

We are awaiting for the courts to assign a date for our hearing.   We need support to prepare for our day in the Chicago immigration courts. We're told we may have to be present in court up to three times over the next two years. Our costs will include travel, hotels, lawyer fees, and court filing fees. 

We are also seeking support to investigate a potential Federal case against the United States government for:

1. Aiding and Abetting undocumented to stay in the United States which the government now proclaims to be their "crime." More than a decade ago, Enrique walked across the border and turned himself in. Authorities detained and processed him and then, after two days, transported him to a greyhound bus stop where  he was encouraged to travel to Indianapolis to join family. Language barriers left him unaware of what was happening at the time as enforcement agents intimidated him to sign documents that he did not understand. (see deportinglove.com to learn of Enrique's story).

He started a life in Indianapolis where he became a role-model citizen, celebrating his safety and freedom, working for more than 7  years in a metal factory, while caring for friends, family, community, and others.  For more than 12 years, Enrique complied with US Tax code, notifying the US Gov't of his whereabouts via annual income tax processing  only later to discover -- after marriage to Harlon J. Wilson and then filing for a green card application --that he had been ordered deported years earlier in 2006. 

The US Gov't suggests they sent a "Notice to Appear" at that time. Enrique did not receive the notice which is somewhat understandable as Enrique describes the border agents that processed him in 2005 were rude and brash and refused to retrieve the address of his uncle (where he would be staying) that was written on a piece of paper, folded up, and stored in his jacket pocket that was locked away earlier by officials. 

The current (2018) political controls have stripped the powers of the court. Judges' hands are tied. Despite Enrique's every effort to comply and contribute for more than a decade, an unjust deportation order continues. Our lives are being decimated. Our business destroyed. We are living in fear every day. We need help protecting ourselves via legal and financial mechanisms. 

2) A Class Action Lawsuit against the US Gov't for encouraging undocumented to apply for and and receive US Tax ID's,  and then paying into US Income Tax coffers. Pursuant to IRS Tax code that describes an undocumented person's paying of income taxes as a demonstration of "Good Moral Character" that will be considered in future legalization efforts. Enrique, like millions of other undocumented immigrants have only done what is instructed by the US government in their paying income taxes. By now deporting these people, this administration is itself not demonstrating "good moral character" and in fact is robbing the undocumented of their taxes paid. 

Millions of surplus dollars have poured into US Tax coffers  - after decades of contributions by Enrique and other undocumented individuals empowered by the US Gov't to be in the United States.   They are robbing millions from undocumented while  criminalizing all undocumented immigrants with disinformation intended to rally the general population to be against these innocent people in the court of public opinion. The vast majority of immigrants are not absorbing social services. Why would they, when it could be used against future legalization efforts? The vast majority are NOT committing crimes nor are they involved in gangs, moreover, they are caring for our homes, caring for our families, working in the various jobs many American's refuse to do themselves. The uncontrolled deportation of millions - after decades of contribution to US tax coffers - is robbery. Tantamount to ethnic cleansing - this is modern-day destruction of a people, culture, and way of life within the U.S.

The Trump administration's current identification of Enrique and others as "criminals" after allowing him to stay in the US - having taken him to a Greyhound station more than a decade ago, encouraging him to apply for and receive an official U.S. Tax ID, and then coaxing he and millions of others to pay income taxes on the promise of favorable discretion in future legalization efforts only to later be marked a "criminal," makes the United States Government complicit in aiding and abetting  in the creation of the very crime they seek to prosecute.

3)  US Citizen Rights are being negated by the current unjust actions of the Trump administration. Despite our US Immigration approved (I130 ), recent mandates issued by the DOJ, makes it impossible for immigration judges to do their jobs. The evaluation of individual cases is greatly diminished by this administration. Enrique should be allowed to stay within the US simply based on our immigration approved marriage to a US Citizen spouse. This administration is trampling over my rights as a United States citizen. We need funds to sue the US Government on behalf of my (Harlon J. Wilson) Civil Rights and the rights of millions of others.

Summary

It was never our intent to be in this situation. We, like many others, are shocked, afraid, and facing a tremendous uphill battle. We know we're in for a long-haul journey to fight change in the unjust American immigration practices. The power over the adjudication of immigration cases must be moved to a congressional oversight. The current power granted to the Department of Justice gives a single individual, the Attorney General, unprecedented control of millions of lives.  We must change the system, we must change the process, and we must focus on more human-centered solutions in immigration.

We must change the laws! We must move the power structure to bipartisan oversight. The US Government must pay for the unconscionable damage and destruction they have done to millions of innocent undocumented individuals and their US Citizen spouses, families, friends, businesses, and communities. Restitution must be paid to any and all undocumented and US resident families who have been affected by this government's white-collar robbery. The US Government MUST pay for the unthinkable destruction of the lives of many.

Donations will be used to cover the costs of legal fees, travel, research, public relations and advocacy efforts to 1) keep Enrique in the country and keep our family together and 2) to pursue all legal remedies availalable to bring justice for the people taking advantage of for decades by a government that aided and abetted - looked the other way even - while collecting millions of dollars of income taxes only to later unjustly and inhumanely target, terrorize, incarcerate, separate from their loved ones, and deport those who demonstrated the "good moral character" as called for.

In the event we do not continue our pursuit of legal remedies and/or bring forth a lawsuit, or if surplus funds are raised, donations will be donated to the great work of the "Southern Poverty Law Center " and Immigrant Welcome Center in Indianapolis.
