The beneficiary of this fundraising is a longsuffering wife and mother of five... with the only remaining minor child in her daily care.
Out of reasonable concern for their safety and well-being, Ms. Kelly fled her own home with her college-student daughter, and youngest son "Roo" in mid-2014.
Her daughter graduated with honors, and has relocated for post-graduate studies. "Roo" remains in his mom's daily care. He enjoys flag football and other sports -- a very bright and healthy young man.
THE NEXT BIG PROBLEM: In late summer of 2015, Kelly discovered that the normally routine care and management of her family law case had been badly mishandled, AND --that she had been deliberately misled by her own attorney.
Now this attorney has abandoned Kelly's case at a critical point of time --along with more than 30 other open cases-- dissolved the law firm, changed careers, and relocated to points unknown. Not a single dime was offered in refund of retainer or legal fees.
THE CHALLENGE: Ongoing legal matters are now in the hands of a trusted and experienced law firm. YET-- Kelly has been advised that many hours of "salvage work” and case reconstruction are needed for their protection and preservation of her custody of “Roo".

Below: Please find the text of a letter written for all of us, from the family who has provided safe harbor and shelter for Kelly and Roo since the onset -- now three years ago. Their simple, eloquent appeal speaks for itself --
LETTER FROM THE CLOUES FAMILY:
Dear friends, relatives, RA Warriors, and other concerned individuals:
First, let us express our sincere appreciation to those of you who have so generously provided resources of time, prayers and funds to assist in this ongoing struggle to provide relief for Kelly and her son, Roo. It has been over three years since Kelly and Roo sought refuge away from what many would consider an intolerable living environment.
The next step in the law case is for the court to determine a final judgment regarding financial and other matters such that Kelly and Roo can move forward with their lives. Kelly and Roo still need our financial assistance in order to accomplish this. As you read this update, please remember to pray for them-- and please consider a generous gift as well. Any and all funds provided will be used solely to pay for lawyer fees, court costs, and any other associated expenses.
We are under the firm conviction that every child should have the advantage of living in a peaceful, stable environment conducive to learning, growing, and maturing. We believe that moving forward with this law case expeditiously is essential to their healing and restoration. We deeply appreciate anything you can do to help Kelly and Roo.

I have to be thoughtful and a little cautious as I encourage you all -- It is well known that the "ex-'s" attorney reads this page regularly; she has waved printed copies of GoFundMe pages at Kelly, the magistrate -- and myself -- in formal sessions of the courtroom.
There are many things I want to share with you about the extraordinary essence of this protracted legal contest and spiritual battle. I am working on discreet methodology to connect with you in order to give you more of the big picture. I am still learning the world of techno-capability. Stay tuned....
For the moment... please accept the words that seem incredibly insufficient to me-- for your generosity and sacrifice of your resources to help our relatives-- your sister-in-Christ. Kelly and her minor son; THANK YOU ALL FROM THE BOTTOM OF THIS OLD MAN'S HEART!!
I am leaving this morning to drive to Central Florida again... For the record... I have always borne my own travel costs to/from... with lodging and meals... out of my own pocket.! I have received some private and voluntary contributions for these expenses... yet not a dime of the GoFundMe proceeds have been used. Your donations are only drawn for attorney fees, hiring expert psych-analysts to assist the legal team, and court costs.
There is a continued hearing on Tuesday at 1pm EDT. Please pray - with fasting & intercession if you are so led and inclined.
It is time for a breakthrough-- and for the logjam of process w/ legalese and a broken system to find favorably --for this gifted young man who deserves a chance to live-- and grow up --in peaceful and loving environs.

Roo's 11th birthday will soon be here. I wish I could give him only one Happy Birthday Gift: THAT would be the final resolution of this heart-rending struggle for his safety and well-being. The saga of this protracted legal contest continues.
Kelly and Roo still need our financial assistance- substantially... and timely. As you read this update, please remember to pray for them-- and please consider a generous gift.
FIRST: After a thorough review & double-check of all expenditures of fund-raising through this GoFundMe page, I want you to know that every thin dime has been spent wisely and correctly, as legal aid for Kelly and Roo.
The lion's share of costs have been for the attorney's fees. There have also been substantial expenses for professional time and travel of expert witnesses, and some administrative necessities like hearing transcripts and obtaining legal affidavits from other witnesses now living out of state.
SECOND: As we know, the court event in April awarded some first-level temporary financial support, and it seems wheels of official mechanisms -- tracking, accounting & disbursing -- seem to turn quite slowly. The first support funds ordered for Kelly and Roo, and due since May 1st, seem to be just now emerging from the state child support system.
It seems "ex-" will indebted to Kelly due to non-payment of ANY support for these two years. Based on the amounts recently awarded, the arrearages will prove to be serious point of contention moving forward. However, there are no expectations for those arrearages to be awarded until the final orders by the Court.
NEXT: The legal battle for the well-being of a gifted 11-year old still rages. Since December, there have been additional and extended visitation patterns in place; the resulting effects are proving quite detrimental for him. Nightmares, spontaneous emotional outbursts, and other telltale signs of overstress have required additional therapeutic appointments with trusted healthcare providers.
SHENANIGANS: The opposing legal team recently issued a subpoenafor the boy's health provider to sit for extensive deposition over several hours. This took place past week. By the existing rules, Kelly has to pay for her own attorney's time & travel, and the court reporter, as well as the doctor's professional hours for giving his testimony. There is another court hearing this week for several motions. This event will take several hours as well, in court.
MEANWHILE: We have recently made several inquiries of malpractice law firms, with a view towards pressing the claim for breach of duty by her former counsel, and eventually recovering some of the substantial funds previously paid into that now-defunct law firm. We have been advised that Kelly has a solid claim -- though we have also been informed that filing a formal claim leading to that recovery will take a long time.
THIS WEEK: Kelly's attorney has advised that, with all the paid-hours activity, the retainer and fees paid in advance are being rapidly depleted. With a recent detailed accounting of time & costs by this law firm, and no discrepancies in their billing, the implications have been made clear. Placing the case on-hold and losing the initiative isn't a good move at this juncture.
Folks, it remains so very important that recent gains be consolidated and momentum preserved! Please consider a generous gift!

The in-court event last week in FINALLY saw some first-level breakthroughs for Kelly and Roo. This event was a 4-hours-long; a hearing on the Motion for temporary financial relief. I was called to answer questions about this legal aid campaign page; and I was proud to let the court know that our family and many friends were standing with Kelly and Roo in this extraordinary legal contest.
By way of reminder: Since May 2014, there have been NO PAYMENTS for spousal support or child support by the estranged husband. Through a withering barrage of distractions, unorthodox tactics and slick sleight-of-hand, these simplest & obvious "first-matters" of family law became convoluted and quite complicated for these two years -- TWO YEARS!
NOW BEGINNING May 1, 2016: The Order being handed down requires sufficient payment(s) for support via the family court system. While this temporary support structure is indeed good news going forward, the issues of retroactive payments for these now-official amounts still hangs in balance, pending a final outcome.
Kelly and Roo continue to live in safe quarters in the home of gracious and compassionate friends, and materially assisted by extended family many other friends for these last 24 months. They are now looking forward to finding their own new place of residence in the foreseeable future. Perhaps most importantly, she has been able to sustain this legal stand for the sake of her young son; to fight hard against many setbacks; yet thankfully --lately -- to turn the tide... THANKS TO YOU!

All states have attorney disciplinary committees & NY has the Lawyers Assistance Fund for people who have lost money due to attorney misconduct. There are also fee arbitration programs that help clients reclaim unexpended fees from lawyers. I hope this info will help.
