My court case v HPV vaccine

My name is Fiona Kirby and I am asking  the High Court in Ireland to withdraw  the license for the HPV vaccine as  I am convinced that it has destroyed my daughter's health and the health of  up to 200 girls here in Ireland. 

When I started this case in October 2015 there were 90 girls affected, now in December just  2 months later that figure has gone up to almost 200 girls.

To date, I have been in court 4 times which has  cost 1,400 Euros in total.  I have represented myself so far but the case is  getting complicate and is much more challenging than I anticipated. I  have therfore  decided   to  get legal representation to ensure that there will be a temporary withdrawal of this vaccine until it  has been properly investigated. 


This is my story.

My daughter Aoife, received the HPV vaccine on September 12th 2011. Previous to the HPV vaccine,  Aoife  was a healthy normally developing  12 year old  girl. She had no previous illnesses or know allergies. She was very bubbly and outgoing, and was involved in many activities such as hiking, cycling, swimming and camogie.  She enjoyed going to school.

This all changed after she received the first dose of the HPV vaccine. A day after the vaccination she developed a severe flu like illness which lasted 10 days. She had bizarre symptoms such as hallucinations and could not bear being touched as it hurt so much all over her body. She was unable to leave her bed during this time.  I myself am a nurse and at that time I  thought that this was due to a viral infection.


 Without any further thought,I agreed to the second dose of the vaccine two months later on November 14th. Within hours of getting the vaccine Aoife became very ill.   Strikingly, her symptoms were the exact same as she had after the first vaccine. This convinced me that it was the vaccine that was the cause of this unusual severe illness. Like before these severe symptoms lasted a full 10 days. Not long after this Aoife started to have recurring infections

 I was initially hopeful that these would pass, however new symptoms arose in ever changing combinations.  Aoife’s general health declined rapidly, despite all therapeutic efforts, including visits to the GP, referrals to a Consultant in Paediatric Medicine, a Consultant Physiotherapist and a Dietician.



     I am a single mother so I had no choice but to care for her daughter. I am now out of work 4 years and Aoife is in receipt of disability allowance. During the past 4 years there have been glimpses of hope, when she had short periods of relief, but these are always followed by an increasingly longer period of being completely incapacitated.
 Besides ongoing physical pains, Aoife cannot concentrate for any length of
time and is only able to attend school sporadically. She goes through phases of black depression. A daily feature is her complete lack of energy and lack of attentiveness. She spends so many afternoons lying on the sofa looking out at friends playing on the green, simply not even having the energy to sit on the kerb to chat with them.

To date  194  girls in the Republic of Ireland have come forth reporting severe ongoing ill effects after the HPV vaccine. They all experience similar devastating symptoms. All these girls were healthy before getting the HPV vaccine.




This problem is a worldwide problem,  in Denmark at the end of June 2015, a county with a similar population to Ireland, 1,586 girls have reported side effects from this vaccine. 543 of these reports are serious and severe.   Denmark now have  five clinics established  specifically to diagnose and treat these cases.

Many people will be aware that the  European Medicines Agency (EMA)  have recently been asked by Denmark to look into the serious health problems after HPV vaccine.
As a result of this request from Denmark the EMA carried out a safety review .  The EMA  said at the start of their review that the review  would not change the risk benefit balance of the vaccine , they concluded at the end of the review by saying that they will be making no  changes to any of the  recommendations. 

A quick look at the  EMA review gives an impression that all  safety concerns have been addressed, however on closer inspection, the EMA say that the method they used to assess reports of serious injury  in the  review are not a means of assessing causality ie they do not say if the girls serious illnesses are or are not caused by the vaccine . When Denmark  asked for a safety review they were looking  for further clarification of the safety issue of the vaccine as their own investigations could not determine if the vaccine was at fault, neither could it rule out the vaccine. So the EMA review failed to directly address the concerns raised by Denmark.   

Interestingly  on the 24th of October, the Danish government allocated
€900,000 to fund an independent study into the side effects of the HPV vaccine.

Japan took Gardasil off its recommended list of safe vaccines in 2013 because of the high rate of serious side effects reported. They reviewed this decision earlier this year and have decided not to change this recommendation. They have introduced guidelines to help with treating and diagnosing girls who present with suspected adverse reactions to the HPV vaccine.

What has been done to my daughter cannot be undone. I will personally have to carry this burden till the end of my life, as it was I that  gave consent to this vaccine. I personally gain nothing by winning this case. I feel terribly guilty for ever consenting to this vaccination and for not having taken decisive action in the past once it became perfectly clear to me that the HPV vaccination is the cause of all of this. Every day there are new reports of more innocent girls being struck down by these devastating and long lasting vaccine side effects. Their lives are destroyed and their future is bleak. All of this could have been prevented.

The above is the basis of my legal challenge asking the HPRA to withdraw the license for the HPV vaccine.
