Injured Worker denied Worker's comp

Hi my name is Jettie Smith. I am the wife of Randy Smith. On December 11, 2015 Randy Smith was hurt coming down some steps at work . It was reported on time. Got worse the next day and was taken to ER . Seen and released with meds and was told to get an MRI to see what was going on. Being that it happen on the job he notified the people in charge. He was taken out of work for three days. On that day he was told to go to their recommended Doctor. He was treated as if it was a sprain. He went back to work the following Monday on light duty and went to the doctor / rehab 3x a week. This lasted for over 6 weeks. Never once did they offer an x-Ray nor a MRI. The last Friday in January , he was denied workers comp and was told he could not go back to work till he was released from his doctor. Long story short ... We found him a doctor that did an x-Ray and MRI within that week. He was told that he would have to have surgery due to his condition. On May the 9th he had a 6 hour back surgery which was very severe.

The surgery was well needed but the recovery will take 6-9 months with a lot of restrictions. Even though he was denied workers comp we started receiving a small check each week but it only lasted a total of 26 weeks. At this time. He is receiving zero dollars and we all lost medical / health insurance.

Randy has been an elevator installer for over 20 years. He has always been a hard worker, never laid out and was very dependable. Now he has no job, no insurance or income all because he got hurt on the job. He feels that he is letting his family down. Randy has twins that are 14 and just started high school. They love their daddy and wants him better. I'm working 2 jobs and it's not enough to keep this house out of foreclosure or the lights on. We do have an attorney for workers comp and personal injury but even if he wins. They will only appeal and prolong this was another year or two. Randy is a person that never ask for help or hand outs. When I told him I was considering this I told him it was for the kids and keeping a roof over his kids head. (Ours too).

It's so hurt to see a grown man down. So as his wife I have decided to ask for help. We have no one. Both sets of parents are gone . We only have each other. I'm working lots of hours but being away from him and the kids are very hard on all of us.

We are asking for help. This could happen to any one. He went from making almost $30 an hour to making $0 an hour. I know we all are suffering with something. If you can't donate I am asking for prayers!!! We surely need them. Thank you in advance. We will overcome this but it's been really hard so far and we still don't see the light nor the tunnel.

Update on Randy Smith : WAS not a good dr visit. His BP was 145/115 he has inflammation and has started on steroids. No x-rays was taking today because he is having issues that has to be taking care of immediately. Has to get blood work done before he is seen again by his surgeon. Hopefully just a little set back Please continue to pray. Still no word on the workers Comp or personal injury lawsuits. One day at a time!!!

I thought I would update you all like I said I would. The court was in September and as of the first of February , the judge has 45 days to make a ruling. At that time we will know if we won or lost. If we win ... Workers Comp will most likely appeal and then it goes through another committee which again will be 45 days. If by chance we lose ... we will appeal. It's just a waiting game.

Randy is much better but still has bad days with numbness in his legs and gets really tired all through the day. Honestly, I think it's more depression than anything. He still as of this moment have not received a penny from anyone and of course the bills are piling up day after day. I'm working as much as I can but my income don't come anywhere close to what he made. I have gotten insurance on us four now but that's just money out of my check that could go to bills. His doctor won't see him until we pay what we owe. Hopefully when we get our income tax we can get that paid so he can go for an update. He can't go back to work till he is cleared anywhere and he's still under doctor care.

We did hear some good news. This has became an international issue and the company will be investigated for not doing the right thing. We agree, if this can prevent someone not going through this... it's worth it. We have friends that have been helping us with our light bills for several months. That has helped so much. So much has happen to us in the last year that we just laugh because there's no more tears to share . I love my little family. They are my world and we are his world. Randy is a strong person but all this has made him sad, depressed, bitter and at times just pitiful but we have faith that soon we will get over this turmoil and be able to breath again!!!

We want to thank everyone for the donations and I can only promise you that every penny went to good use. We have met some good people through this journey also. Just please keep praying for us. Our kids are our life. We push them to do good and push for their dreams and we support in all they do. They shouldn't have to go through this. They are why we keep going. Please continue with prayers. One day at a time .. Thanks

Several people has asked for an update on Randy's Workers Comp case. Nothing has changed. He is still out of work. Next Dr visit is in February. His lawyer is saying it could be April or longer before this ends. He's getting stronger physically everyday but mentally is not so good. He worries daily, hourly for his family. Kids are being strong and I'm working as much as I can. We are not looking forward to the holidays but with kids. You have to do your best and hope for a miracle. Please keep us in your prayers. UPDATE: Randy went back to his Surgery doctor for his 6 month post op visit. Had X-rays and was told he was about 75 % back to par. Still on light duty which his company don't have so he's still out of work with no income. Hopefully we will hear something on the workers comp case by Nov 9th from deciding judge then the appeal process will begin. Please pray soon things will get better.

There are not many, and their skills vary, but check Mediate.com for one in your area and make some calls. Mediators are solution oriented, and as you are learning, lawyers are not. Do you and Randy have a blog yet? Are you on LinkedIN? Have you started a support and awareness group on Facebook? Are you Tweeting to #POTUS and the new Secretary of the Department of Labor - if they ever approve one? Check with your local television station. No light duty available? Sounds like the employer might be courting ADA violations. Have you checked with DOL, ADA and EEOC? Every state is different; in California, that's a very big problem for an employer. DOL even has a Whistleblower site... not sure if it works; worth a look. http://www.whistleblowers.gov/ Best wishes, L

Don't delete any of it.... until you have a signed and Court approved fair and reasonable settlement. Start a blog. Do a google search, "What's YOUR Work Comp Story" ... you'll see you are truly not alone.... and it is just one fight.... FOR HUMAN RIGHTS AND CIVIL RIGHTS. Just today an industry expert wrote this to me..... read it carefully.... it will help you and yours understand exactly what you and all American Workers are up against.... ."Linda while you are obviously well intentioned, your perspective is distorted. The vast majority of workers comp patients are treated fairly and well. A few are not. Your efforts and PP's denigrate and insult the hard work and diligence of many very good people in the workers comp industry." Get a lawyer and they will tell you whether or not you have a case or not. They will take your case if they feel it is a good case and you pay nothing until they collect for you.

How can u get hurt on the job and be denied workers comp ? I went thru workers comp back in 89 -90 and it is a complete joke. I was just approved for permanent disability back in December. Sorry just venting. Get well soon. Sending some money your way

I have been through 4 back surgeries, good luck on healing up. If need be think about working in a signatory company office we always need good union men and women in the offices to protect our union and its members.
