Our family is a military family. My husband has served almost 15 years in the Navy. We have 6 wonderful children all boys, ages 8, 7, 5, 3, 2, and 3 months. 3 of our children have autism, 3 have heart defects, 4 have Ehlers Danlos syndrome, and 4 have GI issues. We have had nursing care 12 1/2 hours a day, 7 days a week for 5 1/2 years. We have had Behavioral therapist in the home for 4 hrs or more M-F for 5 1/2 years. We have had OT, PT, Speech and many others in our home for 7 years.
Over Christmas break, we had a nre nurse start with our family. During this time, out 3 month old became sick with pneumonia and was in the hospital. My husband was putting our 3 year old in time out and he hit his face on the floor. The new nurse saw the mark on his face and accused my husband of punching him in the face. Cps was called and that is when craziness began.
Cps took our statments and our.3 year old told them he hit his face on the floor. They left my husband in the home that night but had me take Jeremiah to the ER. The ER told me he had abbrasions on his face but no tenderness to the touch or any other signs of injury. Almost 2 eeeks went by and no one contacted us or our lawyer. Then we find out that they had issued a protective order against my husband removing from the home. They had scheduled a court date without consulting our lawyer or even giving him a supena to be there. When we read the reason for the protective order, we found statements regarding a case 7 years ago that had been proven false were written on the court document, claiming them to be true allegations and accusations that my husband was a regular abuser. At this point, none of the health care workers or behavioral therapist or anyone who knows our family had been contacted or interviewed. So, our lawyer filled sanctions against cps and charged the social worker with purgery and claimed they were being biased and not doing a proper investigation. Medical records on the child had not even been pulled. The judge was not happy and agreed to hear the purgery charge. Cps asked for a 30 day extenstion to issue supenas and said they were not ready to try the case when they were the ones to schedule this court date. That was a Monday. They were informed our lawyer was going out of town that day. This was a Monday. That Friday, my husband was arrested and charged with assault and battery. The DA had been given the purgerous documentation and the judge did not have any documentation from the court apperance that Monday. At the Bond hearing, the city attorney had to stand before the judge and explain that the information was not accurate, that the children had not been checked on at all and no interviews had been done, and medical records had not been obtained. Bond was set and a court date set. Instead of admitting error or wrong doing, cps decided to supena all the caseworkers from 7 years ago to testify against us. They then have since demanded we get psych evaluations and started making claims that I was not capable of protecting the children from harm. They then obtained medical records, spoke to 2 people who work with our family and were told that the reporting nurse had made multiple different stories about what happened and that our family was a good family and they had never witnessed abuse in the home. Even still, they are attacking our family and continue to make my husband have no contact with the children. This is clear harassment of a military family with children with special needs. Please help us keep our family together. With the many special needs and multiple children, attorney fees are more than we can afford. Thank you for your support!
