Wilkins et al versus the State of Ohio and the Humane Society of the United States (HSUS) is the most important legal case ever faced by pet and livestock owners. The Humane Society of the United States petitioned the federal courts to become a party to the case declaring that Ohio’s Senate Bill 310 was their model legislation for the country. If HSUS can prove their regulation legally defensible they intend to spread it across the fifty states. This regulation is the HSUS’s major push towards a total ban on animal ownership in this country.
HSUS receives over $200 million a year in donations from unsuspecting contributors, supposedly to care for homeless animals. HSUS are sheep in wolves clothing. Less than 1% of HSUS’s annual budget goes towards animal care and 100% of that 1% is spent on euthanasia. HSUS’s stated goal is the elimination of the keeping of all animals in confinement. Confinement, being defined by HSUS, as a dog or a cat being loose in your house or your back yard.
HSUS’s Senate Bill 310 is open ended on the scope of animals that it covers. The current regulation covers hundreds of animals but it allows for unlimited expansion of the list of targeted animals. This means any animal can be a target! Although it is portrayed as an exotic species regulation, HSUS’s model legislation includes native species. The original regulation included all reptiles and hundreds of mammals. 99% of the animals defined as wild and dangerous in this regulation have never caused a human fatality. All infractions are felonies. Two felonies and individuals are banned from owning an animal of any type ever again in their state. Police state powers are given to HSUS and its allies, who are non- governmental organizations. Rumor constitutes probable cause to have ones private property searched. The regulation holds HSUS and its allies harmless for any damage to animal owner’s property, their person and an animal can be killed on the spot. HSUS and its allies of domestic terrorists have given themselves the right to have free rein to terrorize animal owners.
According to the federal judges having heard the case, Wilkins and his co-plaintiffs, have proven that no American has ever been killed by an escaped exotic animal so this regulation is not a response to a public safety issue. Again, over ninety percent of the animals covered by HSUS’s model legislation have never caused a human fatality. Once you understand HSUS’s true motive their irrational actions begin to make sense.
Based upon the facts of their case, the plaintiffs in Wilkins et al versus the State of Ohio and the Humane Society of the United States have won their case. HSUS and its allies have been successful, so far, in getting favorable decisions in compromised forums in the backrooms of the lower federal courts. The United States Supreme Court is another matter all together. HSUS and its allied special interest groups are at a disadvantage at this level. But, in the future, in this country, access to power is being controlled by those who have money. HSUS was able to buy our politicians and influence the lower courts. To counter HSUS and its allies we must band together to defend ourselves. We do not have to match HSUS and its allies in funding we just have to pull together enough resources to defend ourselves and we are very close to making that happen but we need your help. Getting this case a fair hearing is all we need to be victorious. This is a case that animal owners worldwide cannot afford to lose and an ultimate win in this case will deal a devastating blow to HSUS and its allies.
